Terms and Conditions
1. DEFINITIONS
Terms and Conditions or General Conditions: this text representing the general terms and conditions of purchase and use of goods and services offered to the Consumer by the Trainer
Trainer and/or Owner: Francesca Paola Catrini (MFO-Mindfullnessolistico), with registered office at Via Terre dei Consoli 1-01030 Monterosi (VT)
User or Consumer: the user of the services provided on the Sites or, more generally, one who acts for purposes unrelated to their professional or entrepreneurial activity
The parties: the parties to the contract understood jointly, Francesca Paola Catrini and the Consumer
Sites or individually Site: the URL addresses where the products and services of the Trainer can be consulted and purchased and to which these Terms and Conditions refer.

2. SUBJECT OF THE CONTRACT
These terms and conditions govern the contract concerning the sale of products offered by the Trainer.
Purchasing products online implies full acceptance, without
reservations, of these current general sales conditions. The
General Conditions will remain valid and effective as long as they
are not modified and/or supplemented by the Trainer
himself/herself. Any changes and/or additions to the General
Conditions will take effect from the date they are published on the
Site and will apply to sales made from that date onwards.
The Trainer is not responsible for any delays or delivery problems
caused by couriers or force majeure events.
The Sites provide an Internet sales service of products and services in the field of training and content enjoyment. Products not available are sold out until new availability occurs.
The Trainer may accept Customer orders within the limits of existing quantities of requested Products. Therefore, acceptance by the Trainer of a purchase proposal submitted by the Customer is subject to availability of said Products. The Trainer undertakes to promptly inform the Customer of any unforeseeable stock shortages due to excess demand or other causes
Electronic products (eBook)
The User can download individual eBook files directly from the Site in the “section”. eBook files are available in the format indicated in the product sheet.
To read eBooks, an e-Reader equipped with reading software is necessary. The User must verify before purchasing that the format of the eBook they intend to buy is compatible with their e-Reader.
The Trainer and/or distributor may equip files containing eBooks with protection systems. In such cases, these protection systems limit transferring files containing eBooks between PCs, Devices, and other tools used for reading eBooks.
The Trainer will send an email to the Customer summarizing their purchase along with the related invoice.
"ISBN - International Standard Book Number - is a number that uniquely and durably identifies internationally a title or an edition of a title by a specific Publisher. Besides identifying books, it is assigned to all those products created to be used as books. Since January 1st, 2007, ISBN consists of a code of 13 digits, divided into five parts by hyphens. It is defined by an ISO standard derived from English SBN coding from 1967. Although not mandatory, its use has become essential for placing book products into large distribution channels. The Trainer regularly assigns ISBN codes to all his/her products. "
E-learning courses
The Trainer provides Users with numerous in-depth courses, both free and paid. Course content can range from simple recorded lectures to coaching activities carried out through modern communication technologies.
"Access to courses takes place via accreditation provided by the Trainer following purchase, usually sent via email. Among courses offered by the Trainer there are also video courses accessible online through his/her own portal. Once access credentials have been received, it will be possible to enter reserved areas, follow or download courses for which accreditation was granted."
"Live events"
"The Trainer organizes live training events. Such events will be accessible exclusively to a qualified and pre-identified audience; The Trainer reserves the right to suspend or withdraw offers if maximum participant numbers are exceeded. Depending on registration numbers received, The Trainer may cancel or reschedule courses with at least five days' notice sent via email provided by User. In case of cancellation, The Trainer will issue a bonus crediting Consumers an amount towards purchasing participation in other events."
Entry to the live event is nominative. The Ticket may be transferred to another person no later than 15 days before the event, by sending written communication to the address indicated in the purchase form.
The Trainer reserves the right to refuse the transfer.
Any expenses (meals, coffee breaks, overnight stays, etc.) are excluded from the ticket price and, unless otherwise indicated by the Trainer, will remain the responsibility of the User.
Coaching and Continuous Assistance
The Trainer offers Users live training courses through digital channels via remote sessions held by the Trainer's collaborators, during which modules subject to specific coaching activities will be delivered.
Some interactive Products of the Trainer will be provided with group assistance delivered remotely on a continuous basis, through which, by live interaction with the Trainer's collaborators, the training and coaching activities provided by the Trainer himself will be supported and completed.
The Trainer also provides the User with a private interactive forum, within which technical assistance will be provided daily through the Trainer's collaborators for accessing all Products subscribed to by the User and to support the coaching activities delivered live remotely via digital media.
3. PURCHASE AND PAYMENT METHODS
Products can be purchased through forms made available by the Trainer on his Sites either in a single payment or through monthly installment payments, via different methods. Available payment methods are:
Credit card:
If you choose payment by credit card, make sure your issuing bank enables web purchases, ensure all data is entered correctly and that you have passwords for security circuits Verified by Visa and SecureCode by Mastercard. Accepted cards are Visa, Visa Electron, PostePay, Mastercard, American Express, Diners Club International.
PayPal:
PayPal is an online payment system requiring opening a PayPal
account. By completing a purchase with this payment type, a PayPal
site page will appear: enter your address, personal e-mail and
password of your PayPal account or access procedure to create a new
account. After registration you can proceed with payment via PayPal
without re-entering your data for future purchases. Choosing this
payment method charges the amount directly from your PayPal account
at order acquisition. For each transaction executed you will
receive a confirmation e-mail from PayPal. In case of cancellation,
the amount is refunded to the customer's PayPal account.
In case of payment in 3 installments without interest with PayPal,
successful approval of the request depends solely and exclusively
on PayPal itself and not on the trainer or his intervention.
Acceptance of cookies is essential for any purchase or subscription on the Site
Bank Transfer:
For purchase via bank transfer, after receiving the purchase order from the customer, the Trainer will send all his details to allow the User to give instructions to their bank to credit the previously specified sum into the Trainer’s account.
4. PRICES
All Product prices published on the Site are expressed in Euros and include any applicable national taxes.
The Trainer reserves the right to modify Product prices at any time without notice; however, the price charged to the user will be that indicated on the Site at order placement time and subsequent changes (increase or decrease) after order transmission will not be considered except where prices shown on Site for a specific Product are disproportionately incompatible with normal market prices due to evident material errors.
5. INDUSTRIAL AND INTELLECTUAL PROPERTY
The structure, Layout, Source Code, Plug Ins, idea, Know How, project, trademark, content, texts, graphic appearance, Concept and everything related to Sites and Products are exclusively owned by the Trainer and protected by Copyright.
6. USER OBLIGATIONS
When creating their profile and filling out the form, Users intending to register commit to providing their personal data correctly and truthfully and not uploading unlawful content.
Users agree to use interaction services offered by the Trainer only for discussion regarding topics covered by Trainer’s product offerings; any form of contact aimed at promoting goods or services is prohibited as well as generally spamming or other activities violating current laws or disturbing other users.

In case of participation in a live Event, the user is responsible for their own conduct and agrees to behave appropriately, without obstructing the proper conduct of activities and/or disturbing the instructor or other participants and/or damaging things or people. The user is solely responsible for any injury, loss and/or damage that may occur during participation in the event, even if caused by the action or negligence of other participants or third parties. The Trainer does not provide health protection, accident or life insurance for participants.
Even if the eBook files are not equipped with protection systems, the user is obliged to make private use of the content of said eBook files and in particular not to commercialize, share, modify, reproduce or process them. In no case, under the contract governed by these general conditions, does the user acquire rights related to the exploitation of products in eBook format. The user is also prohibited from removing or deleting protection systems related to the eBook file, if existing. If the user makes untrue statements during registration or purchase order completion, or fails to comply with this article, they will be required to compensate damages suffered by the Trainer or which the Trainer must compensate to third parties.
7. WITHDRAWAL
The Right of Withdrawal is not provided for:
- for ebooks and e-learning courses pursuant to Art. 59 of Legislative Decree September 6, 2005, n. 206, which at letter o) paragraph 1 excludes the right of withdrawal for “the supply of digital content on a non-material support if execution has begun with the consumer's express agreement and acceptance that in such case they would lose the right of withdrawal.”;
- for live events pursuant to the same article, letter n), which excludes withdrawal for “the provision of accommodation for non-residential purposes, transport of goods, car rental services, catering services or services relating to leisure activities where the contract provides a specific date or period of performance.”
It is reserved in case the eBook or pdf has not yet been downloaded and in any case within 14 days from receipt of said link.
7.2 Beyond what is provided by law regarding the right of withdrawal, the Trainer reserves at its sole discretion the right to grant it within 14 days from subscription, guaranteeing in such case full refund of amounts paid.
8. AMENDMENT OF GENERAL TERMS
Where these Terms and Conditions require changes or normative or factual corrections it will be incumbent upon the Trainer to update them by publishing on the website.
If any provision, article or part thereof (present or future) becomes wholly or partly null and/or ineffective or omissions are present within these Terms and Conditions, the remaining provisions shall remain valid, effective and produce effects.
It is understood that the “Parties” will amicably evaluate how to resolve any problems arisen.
9. EXCLUSION OF LIABILITY
The Trainer shall not be liable towards either the User or subjects directly or indirectly connected thereto for delays, malfunctions or suspensions of the site depending on Third Parties or caused by force majeure or fortuitous event (including but not limited to: suspension, slowdown or malfunctioning of telephone service or electricity supply service, internet network malfunctions or internet service provider issues, software used for service delivery impediments determined by laws or acts from national foreign Authorities, legal acts or third party facts, other causes not directly attributable to Trainer); for delays/malfunctions/suspensions of social network platforms used for continuing training courses; for increase/failure to increase business due to User’s activity; failure to achieve desired results despite investments/costs incurred; any damage resulting from teaching; tampering/interventions by third parties on services/devices used by Trainer/User; incorrect use of platform by Users; connection devices malfunction used by Users; non-compliance/obsolescence of devices/programs owned by User/third parties; hosting/domain issues/problems; malfunctions/losses/data leaks/accidental dissemination personal/sensitive data/any other damage following attacks by hackers/thieves/crackers/viruses etc.
The User agrees that Trainer shall not be held liable for omissions/errors contained in materials transmitted via site nor eventual infringement on others’ rights and damages including indirect/consequential damages resulting therefrom nor any type damages including loss of usage rights/information loss/non-gain/damages arising from breach/negligence/harmful actions connected with use/information available on site.
Furthermore excluded is any liability regarding management of "Social Groups" dedicated to products should they remain active and managed after termination with Trainer for purposes different than those Trainer remains unrelated to.

12. LANGUAGE, APPLICABLE LAW AND JURISDICTION
These Terms and Conditions are drafted exclusively in Italian language. Relations between Trainer and Consumer are governed exclusively according to Italian law. The parties acknowledge that any dispute arising concerning interpretation/challenge/enforcement hereof shall be subject exclusively to jurisdiction of Viterbo court excluding all alternative courts.
